Terms of Service

1. Agreement

These terms govern your use of the Distful website and service. By creating an account or using the service you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to do so.

2. The service

Distful analyses content you provide and generates a multi channel distribution campaign from it, then reports on how that distribution performed. The service is under active development, so features change and are added or removed over time. We tell you when something you rely on changes.

3. Your account

You are responsible for the accuracy of the information you give us, for keeping your credentials secure, and for everything done under your account. Tell us promptly if you think it has been compromised. Do not share access with people outside your organisation or beyond the user count of your plan.

4. Your content

You keep all ownership of the content you upload and of the assets generated from it. You grant us a limited licence to host, process, reproduce and adapt your content solely to provide and improve the service for you. You confirm you have the rights to the content you upload, including any third party material, recorded voices or contributions inside it.

5. Generated output

Output is produced by automated systems working from your source material. It can contain errors, misattributions or statements you would not stand behind. You are responsible for reviewing everything before you publish it. We make no warranty that output is accurate, original, non infringing, or fit for any particular purpose, and we are not responsible for what happens after you publish it.

6. Acceptable use

You may not use the service to process content you have no rights to, to generate spam, harassment, deceptive or unlawful material, to impersonate anyone, to break any platform's own rules, to reverse engineer or resell the service, to circumvent usage limits, or to attempt to disrupt or gain unauthorised access to our systems.

7. Fees

The prices shown on the pricing page are the prices that apply. We tell you before any change takes effect on your plan. Fees are billed in advance, in US dollars, exclusive of tax, and are non refundable except where the law requires otherwise. You can cancel at any time and your plan runs to the end of the period already paid for.

8. Third party services

The service connects to and depends on third party platforms and providers. We are not responsible for their availability, their terms, or changes they make to their APIs. If a platform changes what it allows, part of the service may stop working.

9. Availability and support

We do not currently offer a contractual uptime commitment or a formal support response time. We may modify, suspend or discontinue any part of the service, and we will give reasonable notice before doing so where we can.

10. Warranties and liability

The service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, nor for lost profits, revenue, data or goodwill. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. Nothing here excludes liability that cannot be excluded by law.

11. Termination

You may stop using the service at any time. We may suspend or terminate access if you breach these terms, if we reasonably suspect misuse, or if we discontinue the service. On termination your right to use the service ends, and you may request a copy or deletion of your content.

12. Changes

We may update these terms. For material changes we will notify account holders by email and update the date above. Continuing to use the service after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of France, and the courts of France have exclusive jurisdiction, without affecting any mandatory consumer protection you have where you live.
